The Air & Waste Management Association is hosting a discussion about the issues identified by various interest groups concerning the June 30, 2022, U.S. Supreme Court decision, WV v. EPA. Guest speakers will feature West Virginia Solicitor General Lindsay See, who presented oral argument before the Court on behalf of 20 states; Eugene Trisko, who serves as Clean Air Act (CAA) and international Air Quality Counsel to United Mine Workers of America (UMWA), Electrical Workers and Boilermakers; Kathy Beckett, who serves as counsel to CAA regulated sources to include the Midwest Ozone Group; and Brian Bunger, environmental attorney in the San Francisco Bay Area, and recently retired after nearly 20 years as Counsel for the Bay Area Air Quality Management District. This panel with explore key principles of law such as justiciability, major questions, agency deference and impact on regulation of GHG sources. Discussion will include assessment of states’ rights to regulate sources of GHGs independent of federal CAA regulation. The format for this event will be a narrative discussion, accompanied by summary slides.
