Air & Waste Management Association Clean Air Act Policy Changes Webinar Series – Part 2: EPA Guidance on Common Control and Rescission of the Once in, Always in Policy – November 13, 2018, 1:00 pm – 3:00 pm ET

This webinar will include the presentations on:

  • Common Control Determinations for Stationary Sources and Major Sources (issued on April 30, 2018)
  • Reclassification of Major Sources as Area Sources Under Section 112 of the Clean Air Act (i.e., Rescission of “Once-in-Always-in” Policy) (issued on January 25, 2018)

The first memo includes EPA’s refined, but narrowed, interpretation on common control criterion when determining if two or more stationary sources should be combined for permitting purposes. The second memo addresses EPA’s current interpretation on when a major source subject to a Maximum Achievable Control Technology (MACT) standard under §112 of the CAA may be reclassified as an area source.
